Thank you for using the services of Mazatlán Shuttle, collectively referred to as the "Provider". By continuing to use THE SITE, you affirmatively accept and subject yourself to the Terms and Conditions for the use of the website. Mazatlán Shuttle reserves the right to add or modify the Terms and Conditions at any time.

DECLARATIONS

You declare under penalty of perjury, appearing in your own and personal right and/or through your legal representative, that you are a natural or legal person, of legal age, capable, and with sufficient means or economic capacity to bind yourself under these Terms and Conditions, as well as with an interest in acquiring the intermediation and reservation services specified herein, and that for this purpose you resort to Mazatlán Shuttle to act as an intermediary between you and the Providers who are direct providers of tourist services offered on this site.

You declare under penalty of perjury, that you recognize that the services provided by Mazatlán Shuttle consist SOLELY AND EXCLUSIVELY OF INTERMEDIATION BETWEEN YOU AND THE DIRECT PROVIDER OF THE SERVICES. Mazatlán Shuttle declares (a) to be a commercial company duly constituted under Mexican law. (b) That it has authorization to provide ground, sea, and/or air transportation services, and is registered with the Tax Authorities under the Federal Taxpayer Registry number GIA031208G65.

That its corporate purpose consists of the power to:

Consists of the derived intermediation that will exist between the provider's site, including but not limited to, the reservation service for ground transportation, excursions, among others, which may vary depending on the geographical area from where it is accessed. Therefore, once the reservations are confirmed to the 'USER' by the provider containing the tourist services chosen by the 'USER' (according to availability), the provision of the intermediation service by the provider through its 'SITE' https://mazatlanshuttle.azurewebsites.net/ or through the communication channels provided by the 'USER' will conclude, as these tourist services will be provided to the 'USER' directly by the PROVIDER.

That for the purposes of these Terms and Conditions, it acts solely as an INTERMEDIARY between you and the Providers of such tourist services, and that for this purpose, it has the technical and administrative capacity, as well as the necessary material and human elements to reserve on your behalf and at your request the services referred to in these Terms and Conditions.

Once the reservations are confirmed by the provider containing the tourist services chosen by you (according to availability), the provision of the intermediation service by the provider will conclude, as these tourist services will be provided directly to you by the Providers.

USE OF THE SITE

Regardless of your country of origin, you declare that you are of legal age to use this site, subscribe to and be bound by these Terms and Conditions, as well as to be responsible for the legal obligations that bind you with any liability incurred by the use of this Site.

You understand that you will be financially responsible for all use you make of this Site and those who use it using your information to access it.

The Provider grants you a limited, non-transferable, revocable license to use the site in accordance with these Terms and Conditions. You must use this site only to make or purchase legitimate reservations and may not use it for any other purpose, including but not limited to making any speculative, false, or fraudulent reservations.

This Site and its content referred to herein, including but not limited to: texts, paragraphs, sentences, specific combination of words, letters or phonetic elements, graphics, button icons, brands, logos, graphic design works, photographs, commercial notices, patents, commercial method, specific combination of colors and shapes, editorial material, printed formats, search formats, digital downloads, data compilations, source codes, software, are the exclusive property of the provider or it has all the Licenses and Authorizations for such use, therefore you may not copy, reproduce, republish, upload, modify, transmit or distribute such content without the prior written authorization of the provider, except in the following cases:

Where you download to view and print the material contained in this Site or Download or print the material sent to your email by the provider, in both situations you may only and exclusively use it for your personal use, with any total or partial reproduction of the Site or any use of its content intended for commercial profit strictly prohibited.

You may not use any "robotic," "spider" or other automatic device, program, algorithm or methodology that has similar processes or functions, or any manual process, to monitor or copy any of the Web pages, data or content, source code, found on this Site in any case and without the prior written consent of the provider.

In accordance with the above, you express agreement that you will not copy, publish, transmit, modify or otherwise transfer the data or content of this Site to any computer, server, Web site, or other mass distribution medium, for the use of any commercial enterprise, any site, web page, or national or foreign enterprise that represents an economic activity.

You also express agreement that you will not use any device of any kind, software or routine to interfere with the proper performance of this site. Your unauthorized use of this site or any total or partial reproduction of the Site and/or content and its material may violate laws governing Copyrights, Industrial Property Rights, and other laws.

You must respect all notices regarding Copyrights and Industrial Property Rights and may not alter, hide, or destroy any of these notices. The use of such material on any other web site or in any networked computer environment is prohibited.

You are prohibited by the provider from posting or transmitting any material that is unlawful, threatening, libelous, defamatory, obscene, indecent, pornographic, profane, or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. In addition, you are prohibited from displaying or transmitting any information that:

Infringes the rights of other persons, or violates their privacy, or publicity rights, is protected by Copyright, Trademark or other Proprietary Rights, unless you have the express written authorization of the provider or the owner of such rights, that contains a virus, bug or any other harmful item, or that is used to illegally conspire against another person to the detriment of their right to market or compete.

You will be solely responsible for any damage caused by any violation of Copyrights, Industrial Property, or any other class of Proprietary Rights, or for any other damage caused by your misuse of this site.

RESERVATION, PAYMENT AND CANCELLATION POLICIES

Reservation policies

Any reservation change is subject to availability and re-quoting of rates. For more information, please contact us by online chat, email or by phone, mentioning your reservation number.

A reservation is considered completed when you have a confirmation number.

All reservations are requested based on availability. All passengers must travel on the same itinerary to guarantee a group trip.

Prices include all services expressly detailed in the travel documentation, that is, transportation, as specified in the travel ticket or electronic voucher Itinerary;

Services or items not included in the prices: The base prices of the contracted services do not include:

  • A.) Anything not duly detailed in the voucher, which implies an additional charge to what was paid at the time of receiving the vouchers.
  • B.) Extras, additional baggage, wheelchairs, strollers, car seats, medical assistance equipment, personal expenses, VAT and other current and/or future taxes and/or any service or expense not expressly indicated in the voucher.
  • C.) Additional services, such as wheelchairs, amenities, extra meet & greet time, etc.
  • D.) Expenses for prolongation of services due to the voluntary desire of the Passengers, nor the damages produced by cancellations, delays in departures or arrivals of the means of transport or due to unforeseen reasons beyond the provider's control and/or derived from force majeure or beyond the provider's control.
  • E.) Expenses and interest of credit operations.
  • F.) Charges for international operations, which may vary occasionally, in addition to any tax required in accordance with applicable law. If you are making a reservation with a PROVIDER outside of Mexico using a Mexican credit or debit card, your Bank may convert the amount to be paid into your local currency and charge you a conversion fee.
  • G.) Variations in the exchange rate used by the bank different from the rate shown in our currency converter; the amount entered on your credit card Statement may be in Mexican pesos and be an amount different from that shown on the billing summary page for a reservation made on the "SITE". The exchange rate and the charge for the international transaction are determined solely by your bank on the day the transaction is processed.

In case of withdrawal by the passenger from services firmly contracted by the provider to third parties, cancellations will be subject to the contractual conditions under which the latter provide their services. In all cases of reimbursement, the price for the expenses incurred plus the commission of ten percent of the services contracted with third parties may be retained.

The postponement or advancement of the dates stipulated in each case may be carried out in accordance with the modalities, conditions, and availability of the different service providers, having to pay the corresponding penalty applied by the provider and a 10% commission as a concept of modifications and, where appropriate, the rate differences due to a change in season, if applicable. The provider is exempt from all liability in the event of not being able to satisfy the changes requested by the Passenger, applying in such case the provisions of the Cancellation policies.

For Cancellation of Transportation Reservations

Cancellation deadlines will be applied in accordance with the current time in the destination country.

Cancellations made 24 hours or more before the service date are refundable without charge.

Cancellations made 24 hours or less before the date of the second service incur a 50% charge, meaning, to provide for the cancelled service in advance.

No refunds apply if you do not show up at the airport or meeting point on the day and time the transportation service is scheduled.

We recommend that all cancellation requests be reported in writing via e-mail, text message, WhatsApp to the provider, mentioning your reservation number.

Claims and/or refunds must be presented within 5 business days after the end of the trip, in writing, accompanied by receipts and supporting documentation and signed by the passenger. After this term, no claim will be considered. In no case will the provider cover the eventual costs and/or charges and/or taxes and/or liens derived from bank transfers or similar used to make any type of return and/or refund and/or reimbursement.

PRIVACY AND SECURITY

You state that you have read the provider's PRIVACY AND SECURITY POLICY, the terms incorporated therein, and agree that the terms of such policy are reasonable.

You consent to your personal information being used by the provider and/or its third-party providers and distributors in accordance with the terms of the provider's Privacy Policy and for the purposes set forth therein.

LIMITATION OF LIABILITY

The provider shall not be liable, nor assumes any responsibility for any damage or virus that may infect your computer or any other property of yours due to your access, use or browsing of this site, or for the downloading of any material, data, text, image, video or audio from the site.

In no event shall the provider be liable for any injury, damage, prejudice, loss, claim or any special, punitive, indirect, incidental damage due to negligence, or unlawful act, resulting from any use of this site or the content found herein. Any failure or delay (including, without limitation, the use of, or inability to use any component of this site for reservation or ticketing services), or the performance or non-performance of the provider, including, but not limited to, non-performance resulting from bankruptcy, reorganization, declaration of insolvency, dissolution or liquidation.

You shall be liable for damages you generate to the provider, resulting from any misuse or incorrect use you could make of the Site, infrastructure and assets, or on any fraudulent operation or for purposes contrary to the services provided on the site or those that go against the laws and regulations in force and applicable.

This Site contains links to other Web sites which are provided solely as a convenience to you and not as an endorsement by the provider and they belong to third-party providers or distributors of the contents of such other sites.

The provider shall not be responsible for the content of any other Web site and makes no representation or warranty regarding any other Web site or the contents or materials on such sites. If you decide to access other Web sites, you do so at your own risk.

VERACITY OF INFORMATION

You acknowledge and accept your total obligation and responsibility to provide truthful and correct information about the ages, sex, names or surnames of both you and the other user-tourists accompanying you or commissioning you to use this Site, as well as the complete data and information for the formation of the itinerary and the reservation of land services, releasing the provider from any responsibility for itinerary changes generated by improperly provided data, or for any error in the data provided by you for the issuance or purchase of tickets, such as ages, sex, names, surnames, dates, forms of payment, routes, airlines, schedules, classes, categories, special conditions, etc., adhering where appropriate to the cancellation clauses for air, land, sea or cruise services expressed in these Terms and Conditions.

SERVICE REGULATIONS

You agree to abide by and respect the regulations and service conditions established by each of the Providers and direct service providers contracted by you through the intermediation of the provider, so the provider must make known to you those that are most important, nevertheless the provider may make known to you new or additional service conditions over which it has no responsibility and consequently declines any liability that could derive from their non-compliance.

You must, by your own means, provide yourself with the passports or immigration documents required by the authorities of the United Mexican States, and of the destination or transit countries, such as visas, sanitary permits, and all those documents required by Customs, Air, Sea, Airport, Federal, State, Municipal authorities, etc., which are necessary to carry out your trip, releasing the provider from any problem that may arise with such authorities.

For arrivals at the Mazatlán airport, in the cases of international flights you agree to present yourself at the airports and check-in with the airlines at least THREE HOURS IN ADVANCE for international flights and TWO HOURS IN ADVANCE for domestic flights, except for express written instruction you receive from the provider and/or some other instruction to present yourself even earlier by such Authorities.

DISCLAIMER OF RESPONSIBILITIES

The provider acts as an internet agency, providing services in its capacity as an intermediary reservation agent between you and the Provider or direct Providers of the tourist services promoted on this Site. The provider establishes commercial negotiations within its own quality and service standards, such as, but not limited to: ground transportation and other related tourist activities such as tours and excursions, choosing only the most qualified and prestigious providers in the market.

Since the legal nature of the provider is to act SOLELY AND EXCLUSIVELY as an INTERMEDIARY and not as a direct provider of tourist services, the provider does not assume and will not assume any liability generated from any relationship with you and the Final Service Providers and in turn you release the provider from any liability for any failure or lack of compliance by the Provider or direct providers of tourist services, including without limitation any failure or compliance by airlines, hotels, temporary lodging providers, water sports providers, transportation agencies, tour operators, adventure sports and extreme sports providers, and in general for any failure or lack of compliance by all those tourist services that are provided directly by one or more Providers and not directly by the provider.

However, the provider may at its free discretion provide you with contact details and/or address of the service provider so that you can exercise the respective claim or claim route you deem necessary.

The provider does not offer, nor will it offer any guarantee on the services provided directly by the service providers, nor does it guarantee their financial position or any reimbursement to you caused by any loss experienced as a result of the financial condition of said Provider, including without limitation, economic insolvency, or Commercial Bankruptcy in which said Provider may declare itself.

In the event that the service provider fails to comply with any of its services, for which you have already made the payment, the only recourse of reimbursement must be processed directly with the Provider who failed to provide their services, or you may request insurance coverage in case it is applicable or with any other third party, unless the above failure is caused directly by the provider.

The provider assumes no responsibility to you and you release the provider from all liability for acts, omissions or any type of complaint or dissatisfaction derived from the services provided by the direct service providers advertised on the Site, since the provider has no control or legal relationship over their personnel, equipment, operation or assets.

In those situations where the direct provider fails in the provision of their services you may attempt any recourse permitted by the applicable laws against the Provider. The provider guarantees that it has high standards of service and will take special care in the selection of service providers to avoid their failure at all times.

The provider will not be responsible and you release the provider from all liability regarding:

  • A.) The veracity of the photographs shown on its Site as they are only representative and do not guarantee that upon arrival, everything will be exactly the same as it appears in them and describes on the Site;
  • B.) The descriptions of travel services are updated by the provider to its best knowledge, but do not guarantee that everything will be exactly the same upon your arrival;
  • C.) Any type of failure by you to obtain the required documentation for your trip such as, but not limited to, passports, visas, certificates etc.
  • D.) Any type of failure by you to follow travel instructions including, but not limited to, airport departure times, check-in and check-out dates and times at hotels, voucher redemption policies etc;
  • E.) Due to a lack of financial conditions on the part of the Provider to provide the service.
  • F.) Regarding the terms and conditions and/or policies of the direct Service Providers. The provider will not assume any liability and you release the provider from all liability, as well as from all claims, costs, expenses or losses you may suffer including any personal injury or injury to third parties, accidents or death, damage to personal belongings, loss of fun, anger, disappointment, anguish or frustration, whether mental or physical, provided they are the result of:
    • Any failure or default by the direct Provider in providing the service.
    • Any failure or default by you at the time of enjoying the contracted services.
    • Any failure or default by you in observing or complying with the terms and conditions, policies, instructions, recommendations, safety measures, etc. of the Final Providers of the service.
    • Force majeure or acts of God such as: strikes, delays, earthquakes, war conflicts, hurricanes, snowstorms, etc. (that are not attributable to the provider),
    • Acts or omissions of any other person who is not the provider.
    • Illness, theft, labor disputes, mechanical failures, quarantine, governmental actions, weather, or any other cause beyond the direct control of the provider.
    • At your insistence to perform any type of trip, tourist activity, take a tour, excursion, take any type of air, land transportation, and of any type, under precarious health conditions or that are not optimal for the development of such activities, as well as the development by you of any type of extreme sports or activities that may imply any danger and that were carried out under your full knowledge, or when you suffer from any type of illness, medical condition, disability, some type of allergy, are under medication or medical prescription, indications of rest and/or all those medical conditions that at your own risk were omitted and that could result in a deterioration to your health at the time of carrying out such activities under consciousness of cause, under such occasions they will always be considered to have been carried out at your own risk, releasing the provider from any complaint, lawsuit, grievance, nonconformity, reward, compensation, compensation, courtesy, etc., derived from any incident caused during the development of any service or activity and any future event derived from the initial incident due to any of these causes.
    • Any other event that is not under the direct control of the provider. You will be responsible for verifying that the final Provider has special services such as access, amenities and services for people with different capacities, physical or any other type, which is suggested you do prior to making your reservation. You will be responsible for reading and subjecting yourself to the terms and conditions and/or policies of the final service Providers.

Full refund will not be applicable in situations where the trip has to be canceled, interrupted and/or postponed by the provider for reasons beyond its control (force majeure, such as, but not limited to, weather, hurricane, earthquakes, acts of terrorism, etc.) and in which the provider's contractual obligations with its service providers do not allow it to obtain a refund of the amount paid or to be paid to the Provider on behalf of the client.

In no case will the provider respond to Passengers for indirect damages or loss of profit alleged by them as long as it is not about facts in which the officials, employees or authorities of the provider have had participation in them.

TERMINATION OF THE CONTRACT

The provider may terminate these Terms and Conditions and/or any of its services at any time without the need to advise or notify such termination, for any cause or motive, including any inappropriate use of this site or your failure to comply with these Terms and Conditions. However, such termination will not affect any right or obligation assumed by the provider towards you once a reservation has been confirmed.

The provider reserves the right to make leave a Travel Plan and/or Tour at any point of it any passenger whose behavior, way of acting, state of health, or other serious reason that in the opinion of the provider causes danger or causes inconvenience to the remaining travelers or can ruin the success of the excursion or the normal development of it, or that can cause damage to third parties.

ASSIGNMENT OF SERVICES

You may not assign, subcontract, or delegate your rights, obligations or duties contracted here.

APPLICABLE LEGISLATION

These Terms and Conditions will be governed by the laws of the state of Sinaloa

You state that you know the scope of this Contract, whose Terms and Conditions are the faithful expression of your will and submit, in the event of non-compliance or interpretation, to the competence of the Federal Consumer Protection Agency (Procuraduría Federal del Consumidor), in the administrative channel, as a conciliatory instance, to resolve the differences that could arise, and in case they persist you agree to submit to the competence of the Laws and Courts of Mazatlán, Sinaloa, under its exclusive jurisdiction, waiving in turn any other jurisdiction that by reason of your present or future domiciles or due to the location of your assets or your nationality could correspond to you.

To the extent permitted by applicable law, no complaint, claim or cause of action related to your access to or use of this Site must be presented after the expiration of one (1) year following the date on which such complaint, claim or action was filed or the purchase was completed.


PRIVACY NOTICE

In accordance with the Federal Law on Protection of Personal Data, Mazatlán Shuttle will protect all your personal information to avoid any possible damage, loss, destruction, theft or alterations, as well as the unauthorized use of this personal information. Mazatlán Shuttle is concerned about your safety so all the information we obtain will be treated confidentially in a responsible manner.

You declare to have read and accepted the terms and conditions of the Privacy Notice made available, knowing the purpose of the collection and treatment of personal data, as well as the procedure for the exercise of your rights.

Data collection

The personal information you provide to Mazatlán Shuttle and the data collected through the website mazatlanshuttle.azurewebsites.net, by using our online services, as well as other means and formats:

  • 1. Name, telephone number, email address.
  • 2. Financial Information.
  • 3. Information for the reservation of the service to be contracted.
  • 4. Contracted service(s).
  • 5. Credit or debit card number.
  • 6. IP address, browser type, internet browsing preferences on our website and the web pages you visit.

What do we use your information for?

The personal information we collect is aimed at: contact, identification and reservation process, verification, digital sending of documentation, providing information about the status of your online or phone reservations, identifying your purchase history, evaluating the quality of service, and, in general, complying with the obligations we have undertaken.

We may use your personal data with offers, promotions and advertising of our different tourist service providers, as well as products and services promoted by Mazatlán Shuttle.

Who do we share your information with?

Mazatlán Shuttle does not transfer personal data to third parties without your consent, unless it is required solely to satisfy the contracted services. Similarly, Mazatlán Shuttle may transfer your personal data to subsidiaries and affiliates for the purposes set out in this notice; upon request of an authority; and for compliance with the obligations of a legal relationship between the holder of the personal data and Mazatlán Shuttle.

If you have purchased any of the services offered by Mazatlán Shuttle through our website, contact center, App and using electronic payment interfaces, all personal information transferred to a third party is governed by their own privacy policies and practices, which have been carefully selected and take our customers' privacy concerns seriously.

Therefore, Mazatlán Shuttle may hire one or more third parties as selected service providers to support promotional and marketing activities of products, management and administration of personal data collected through the website and App, and to fulfill the provision of contracted services. It is understood that you have consented to the transfer of personal data if opposition has not been proven when they are transferred.

The personal information you provide to Mazatlán Shuttle may be compiled and recorded in a proprietary database of Mazatlán Shuttle. In any case, Mazatlán Shuttle may not market, sell or rent your personal information to third parties without your prior consent. Mazatlán Shuttle is not responsible in relation to the content and privacy policies of sites external to this Web site.

How can you limit the use and disclosure of your information?

You can disable the use of cookies and web beacons through browser settings options in most Internet browsers. Similarly, you may exercise your right of cancellation and opposition to the processing of personal data, or reject the use of personal data for non-essential purposes.

You have the right to access your personal data we possess, correct it in case it is incorrect or incomplete, when you consider that they are not necessary for the expressed purposes, when they are not used for the purposes to which you consented or the contractual or service relationship has ended; and oppose the processing of personal data for specific purposes (access, rectification, cancellation and opposition referred to as "ARCO").

You also have the right to revoke the consent you have given us for the processing of personal data, so that we stop making use of them. The request must contain at least: (a) name, phone and e-mail address, other means to communicate the response to your request; (B) documents proving your identity, and if representation is necessary, legal; (C) a clear and precise description of the personal data for which it is required to exercise any of the ARCO rights, and (d) any other element that facilitates the location or identification of personal data. Mazatlán Shuttle will respond to your request by email and it will be answered within 20 (twenty) business days after receipt. If after this period Mazatlán Shuttle does not respond to your request, then you can start the procedure for the protection of ARCO rights before the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI).

Furthermore, it should be kept in mind that, in terms of the Law and its regulations (indicated above), as of January 6, 2012, you can start the ARCO rights protection process before the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI), within 15 days of the date on which Mazatlán Shuttle responds to your request and this is not satisfactory.

What security and control measures are used to protect your personal data?

Administrative, technical and physical security measures to protect the security of personal information are required to be met by contracted service providers, including the case of services provided by subsidiaries or affiliates.

All information is stored for security reasons, to prevent loss, theft, misuse or alteration. Mazatlán Shuttle may use "cookies" or "IP addresses" to confirm your identification when accessing our sites. The use of "cookies" does not collect personal data of users in terms of the Law and its Regulations.

The protection of the privacy of personal data of minors is particularly important for Mazatlán Shuttle. When Mazatlán Shuttle is aware of personal data of minors, its processing will be carried out complying at all times with the guidelines and requirements established in the Law and its Regulations.

Changes to the Privacy Policy

Mazatlán Shuttle reserves the right to change this Privacy Notice at any necessary time. If there is any change in this privacy policy, it will be communicated through our website mazatlanshuttle.azurewebsites.net. Mazatlán Shuttle is not responsible for the ignorance or lack of notification of change or modification to this Privacy Notice.

Applicable Law

Mazatlán Shuttle is located in Mexico and everything related to your personal data is governed by the laws of Mexico. By providing your information, visiting our Web site, or making use of it, the interested party is aware of and authorizes the use of their personal data to Mazatlán Shuttle in accordance with this Privacy Notice.

  • Full refund will not be applicable in situations where the trip has to be canceled, interrupted and/or postponed by the provider for reasons beyond its control (force majeure, such as, but not limited to, weather, hurricane, earthquakes, acts of terrorism, etc.) and in which the provider's contractual obligations with its service providers do not allow it to obtain a refund of the amount paid or to be paid to the Provider on behalf of the client.
  • In no case will the provider respond to Passengers for indirect damages or loss of profit alleged by them as long as it is not about facts in which the officials, employees or authorities of the provider have had participation in them.
